§ 90.16 DOGS RUNNING AT LARGE.
   (A)   It shall be unlawful for any person being the owner of, or having the care, custody, or control of any dog to allow, suffer, or permit such a dog to be at large upon the streets or other public places in the town or in or on any other place beyond the premises of that person, unless the dog be on leash or otherwise under the complete control of a person capable of controlling such dog. It shall be the duty of every Humane Officer and Assistant Humane Officer to apprehend and impound all dogs found running at large contrary to the provisions of this section.
   (B)   Any dog or animal so apprehended and impounded shall be delivered to the animal shelter operated by and under the supervision of the Fort Wayne-Allen County Humane Commission, and any animals once delivered to the Commission shall be under the Commission’s jurisdiction and subject to all of the Commission’s rules and regulations as now established or as hereinafter adopted. The rules and regulations at the present time provide, in addition to other matters, that any dog so impounded may be redeemed by the owner within 72 hours after the impounding of such dog by reclaiming the dog at the humane shelter where it is impounded. For the second such offense the owner of the dog shall pay to the City of Fort Wayne, Indiana, a redemption fee of $5, and for the third and each subsequent offense, the owner of the dog shall pay to the City of Fort Wayne, Indiana, a redemption fee of $10. The fee shall be paid to the City Controller of the City of Fort Wayne, Indiana, who shall thereupon issue a receipt for the fee; upon the presentation of the receipt to the person in charge of the humane shelter, the dog shall be released to the owner thereof. No dog shall be released unless the owner shall also show a dog-tax receipt as proof of ownership.
   (C)   All impounded dogs not released within 72 hours after being impounded may be placed in suitable homes or destroyed in a humane manner by the Fort Wayne-Allen County Humane Commission. The person in charge of the humane shelter shall keep an accurate record of all impounded dogs, which record shall show the time each dog is impounded, the disposition made of each dog, and all other appropriate information.
