Building permit fees consisting of plan review fees, construction/inspection fees applicable to all construction within the village shall be paid prior to receiving a permit. Building permit fees in subsection A of this section are all-inclusive for those project types listed. All other projects shall have total permit fees calculated by sum of all required fees in subsections B through G of this section. The following fees are hereby established and adopted:

Zoning Code Plan Review Fees - Zoning Code review fees shall be required for (1) all single-family new construction; (2) all single-family additions; (3) all commercial new construction, commercial additions, commercial accessory structures including parking lot changes, and change of use; (4) any change of use involving residential occupancy. Zoning Code Plan Review fees are in addition to any required development review fees listed in Title 9, Chapter 3, and Title 10, Chapter 2. Fees shall be as indicated in the table below:
4. Fire Alarm Plan Review Fees - Fees shall be as indicated in the table below:
1. At sole discretion of the Building Official, small projects with scope consisting of device relocation, or addition of new devices, with less than 4 total devices affected, shall be charged minimum fee of $90.
2. Fire Alarm reviews and inspections are typically performed by the appropriate Fire Protection District. This may result in fees and procedures that are separate from those of the Village of Mokena. In cases where reviews are completed, permits issued, and inspections conducted by the respective Fire District, the Village fees and reviews for that scope may be waived subject to Building Official approval.
5. Fire Sprinkler Suppression Plan Review Fees - Fees shall be as indicated in the table below:
1. At sole discretion of the Building Official, small projects with scope consisting of sprinkler head relocation, or addition of new heads, with less than 6 total heads affected, shall be charged minimum fee of $90.00.
2. Fire Alarm reviews and inspections are typically performed by the appropriate Fire Protection District. This may result in fees and procedures that are separate from those of the Village of Mokena. In cases where reviews are completed, permits issued, and inspections conducted by the respective Fire District, the Village fees and reviews for that scope may be waived subject to Building Official approval.
6. Miscellaneous Plan Reviews - Fees shall be as indicated in the table below:

C. Building Construction/Inspection Fees

2. Does not apply to projects assessed engineering inspection fees in accordance with Subdivision standards of Village Code 10-2-15.

Alternate Inspection Fees - For permits with unusual scope or that have potential to exact unusual inspection demands, the Building Official or his/her designee has the option of calculating inspection fees by use of the “alternate method” fees specified below, in lieu of fees specified in other sections of this sub section.
4. Occupancy Inspection and Certificate Fees:
Note:
1. Certificate of occupancy fees for residential properties are only applicable to new construction projects or for duplicate certificates.
D. Elevator Permit Fees:
1. New or replacement elevator permit shall require submittal of $360.00 deposit per each elevator. This deposit is payable at the time of permit and plans submittal. The deposit covers the initial plan review and up to two inspections of the elevator by a third-party consultant. Any additional fees assessed by third-party consultant must be reimbursed to the Village prior to final elevator approval, with an additional twenty percent (20%) administrative fee.
2. All fees stemming from re-reviews and re-inspections conducted by the third-party consultant, shall be equal to consultant cost plus twenty percent (20%) administrative costs, and must be reimbursed to the Village prior to final elevator approval.
3. The fee for routine elevator inspections and certificates shall be the consultant cost plus twenty percent (20%) administrative costs.
4. Whenever the installation of an elevator requires modifications to the existing floors, walls, or electrical system, the elevator permit shall be accompanied by a building permit and plans indicating the scope of the proposed work. Standard building permit review and inspections fees apply to the building permit in addition to any elevator permit fees.
E. Additional Fees:
1. Whenever reinspection or additional inspection of premises are required because of inaccurate or incorrect information on the plan or face of the application for a permit, or because of any code or ordinance violation, or because of faulty construction, or because no fixed or permanent address was correctly noted identifying building location, or no safe access to the site was provided, a charge of sixty dollars ($60.00) per inspection shall be paid before the reinspection is made.
2. A penalty of sixty dollars ($60.00) per inspection may be assessed to any owner, applicant, contractor or subcontractor failing to properly notify and/or request that the village perform required building inspections. This penalty shall be in addition to any action required by the village to adequately perform the inspection.
F. Third-party Consultant Reviews and Inspections:
1. At the sole discretion of the Building Official, he or she shall have the right to have permits and plans reviewed and inspections performed for code compliance by a third-party consultant. If the actual fee assessed by an outside consultant exceeds the total fee as calculated elsewhere in this section, the additional charges will be added to the overall permit fee for the project and must be paid prior to issuance of the permit. If the permit has already been issued, additional fees must be paid to the Village prior to further inspections being scheduled and prior to certificate of occupancy being issued. The Building Official shall have the right to require a plan review deposit to be paid at time of plan submittal in the likelihood that plans will require third-party review. All third-party plan reviews will be assessed an administrative fee of $20.00 for residential permits and $50.00 for commercial permits.
G. Work Without a Permit:
1. Whenever a property owner, contractor, or subcontractor has been discovered to be performing work without the benefit of a permit as required by ordinance, in addition to any other fine assessed by code or by a court of competent jurisdiction, a penalty may be assessed by the village in an amount not to exceed twice the total permit fee, not to exceed $750. Additionally, the building official may issue a stop work order until such time as a building permit is obtained.
H. Calculation of Permit Fees and Cost of Construction
1. Cost of Construction (also referred to as Project Valuation)
a. Each permit application submittal shall include information regarding the cost of the project, also referred to as Project Valuation. See definition in subsection J.
b. The Building Official shall have the authority to request the copy of any legal contract between the contractor and owner for the construction project being permitted for the purpose of verifying project valuation. Alternately, the project valuation may be calculated by the Building Official based on the latest published International Code Council Building Valuation Data or RS Means manual, or by review of comparable projects with known valuation. Whenever unit pricing method is used for estimating the project valuation, it shall be based on the gross area of the building as defined in this section. The Building Official’s determination of Cost of Construction for the purpose of permit fee calculations shall be final.
c. For Cost of Construction of interior alterations, the unit pricing published by the International Code Council or RS Means may use a reduced rate equal to 50% of new construction unit pricing.
I. Refund of Fees, and Fees due on abandoned or withdrawn applications.
1. All fixed-fee permits fees and plan review fees are non-refundable.
2. Refund of fees other than fixed-fee permits and plan review fees, shall be available only when no work has been started. Once work is started, all permit fees assessed in accordance with this section are non refundable.
3. In the eventuality that the applicant decided to withdraw the permit application or abandons the application after submittal, the Village shall be compensated for any plan reviews that have been conducted. For withdrawn or abandoned permit submittals, the review fee due to the Village shall be equal to 50% of fixed-fee permit fee specified in subsection 8-1-12.A, and for other projects the review fee due to the Village shall be as specified in subsection 8-1-12.B. Fee shall be paid within 30 days of applicant being notified of said outstanding review fees.
J. Definitions:
ADDITION: | Modifications to a building, either structural or non-structural, which results in changes to the existing Gross Building Volume, or to the existing roof. Additions must be attached to the existing building. |
ADDITION, ENCLOSED: | Addition where less than 75% of the new exterior building elevations are permanently open to the outside. |
ADDITION, OPEN: | Addition where at least 75% of the new exterior building elevations are permanently open to the outside. |
ALTERATION, INTERIOR: | Modifications to a building, either structural or non-structural, which does not result in any changes to the existing Gross Building Volume, or to existing roof. |
GAZEBO: | Detached accessory structure where at least 75% of exterior wall perimeter is permanently open to the outside, intended for non-commercial recreational use by the property owner and their guests. Following structures are considered synonymous with gazebo for the purpose of this section: Cabanas, Summer houses, Patio Covers, etc. |
GAZEBO, PREFABRICATED: | Gazebo structure consisting of a kit-of-parts, manufactured by a commercial entity offered for sale to the general public at retail outlets, and intended for assembly and installation by the end-user according to manufacturer’s instructions without any modifications to the kit. |
GROSS BUILDING AREA: | Area of the building measured to the outside edge of the exterior walls enclosing the building on all floors. Floor openings such as stairs, shafts, or elevators shall be included in the gross building area. |
PROJECT VALUATION: | Approximate monetary cost of the proposed project encompassing all labor and material costs to produce the final product, but not including value of land. For self-performed work, the labor costs portion of the project valuation shall reflect the equivalent hourly prevailing wages for the region. The terms, Cost of Construction and Project Valuation are used interchangeably in this section and shall be deemed to have the same meaning for the purpose of permit fee calculations. |
K. Discount Incentives for Downtown Rehabilitation, Development or Redevelopment: Building permit fees required by subsections B and C of this section shall be discounted for “downtown” rehabilitation, development or redevelopment construction projects, as follows:
1. New Construction in Commercial Or Office Zoning Districts.
a. No discount for hard costs.
b. Ninety percent (90%) discount for soft costs.
2. Rehabilitation Construction in Commercial Or Office Zoning Districts:
a. No discount for hard costs.
b. One hundred percent (100%) discount for soft costs.
3. New Mixed-Use Construction in Commercial Zoning Districts:
a. No discount for hard costs.
b. Eighty percent (80%) discount for soft costs.
4. Definitions:
DOWNTOWN: | The area directly abutting Front Street between 115th Avenue and Schoolhouse Road, the area directly abutting Wolf Road between Boyer Court and Revere Road/193rd Street, and the area directly abutting LaPorte Road between 115th Avenue and Center Street. |
HARD COSTS: | Actual costs for goods or services provided by suppliers, consultants or other third parties required or necessary for construction within the village, including, but not limited to, such things as engineering and legal fees, publication fees for public hearings, hardware (e.g., water meter), etc. |
MIXED-USE CONSTRUCTION: | Construction project that includes both commercial and residential uses above ground levels. |
NEW CONSTRUCTION: | Construction project that includes new building footings. |
REHABILITATION: | Whole or partial remodeling or reconstruction of a building or tenant space within commercial or office zoning districts. |
SOFT COSTS: | Fees for services performed by village personnel in connection with construction within the village, including, but not limited to, such things as building inspection fees, tap- on fees, etc. |
L. Discount Incentives for Existing Businesses: Building permit fees required by subsections B and C of this section shall be discounted for “existing long-standing businesses”, not located in the downtown, that are performing “major renovations”, as follows:
1. New Construction in Commercial, Office, And Industrial Zoning Districts:
a. No discount for hard costs.
b. Seventy-five percent (75%) discount for soft costs.
2. Definitions:
DOWNTOWN: | The area directly abutting Front Street between 115th Avenue and Schoolhouse Road, the area directly abutting Wolf Road between Boyer Court and Revere Road/193rd Street, and the area directly abutting LaPorte Road between 115th Avenue and Center Street. |
EXISTING LONG-STANDING BUSINESS: | Any business that has operated in Mokena for a minimum of ten (10) years. |
HARD COSTS: | Actual costs for goods or services provided by suppliers, consultants or other third parties required or necessary for construction within the village, including, but not limited to, such things as engineering and legal fees, publication fees for public hearings, hardware (e.g., water meter), etc. |
MAJOR RENOVATIONS: | Any project requiring a permit that generates a minimum of five hundred dollars ($500.00) in “soft costs” as defined herein. |
