10-2-15: PLANNED DEVELOPMENT REVIEW AND INSPECTION FEES:
   The village shall charge fees to developers for planned development review and inspection services on the basis of a fixed fee schedule as set forth below. Such fees shall be paid by certified check, money order or United States currency to the village treasurer, and the plans and plat for any proposed development or subdivision, preliminary and otherwise, shall not be considered without the receipt paid from the village treasurer being first exhibited. Said fee shall not be refunded, regardless of whether the proposed development is approved or disapproved.
   A. Administrative Fees:

   The above fees shall be paid as follows:

   B. Conceptual Plan Engineering Review Fees:

   The above fees shall be paid upon submittal of conceptual plan, but shall be credited toward engineering review fees upon submittal of preliminary plan, after such fees shall have been determined in accordance with subsection C of this section.
   C. Engineering Review Fees:
   1. All single phased planned development plans which contemplate or which may otherwise require the construction and/or dedication of public improvements, shall be submitted to the village for review by the village engineer. The fee for such review shall be determined based upon the amount of the letter of credit, as required for the proposed public improvements, in accordance with the following fee table:

   The above engineering review fees shall be paid upon submittal of the preliminary plan. Should the actual letter of credit amount not be available at the time of submittal of the preliminary plan, the developer shall submit as a substitute therefor an engineer's opinion of probable construction cost for the proposed public improvements. Upon approval by the village engineer, such estimate shall be utilized as the basis for calculating the review fees. Such fees shall be adjusted in accordance with the letter of credit amount when finally determined. Should additional fees be required, they shall be paid prior to final plan approval. If the final letter of credit amount is less than the initial estimate as submitted by the developer, the initial estimate shall be utilized unless the difference between the initial estimate and the final letter of credit amount is greater than twenty five percent (25%), in which case the village shall refund that amount of the difference in excess of twenty five percent (25%).
   2. For multiphased planned development plans which contemplate or which may otherwise require the construction and/or dedication of public improvements and which would require phased engineering review of final plan submittals, the engineering review fees shall be paid as follows:
   a. Twenty percent (20%) of the figure as determined based upon the amount of letter of credit for the entire development, as required for the proposed public improvements, in accordance with the fee table set forth in subsection C1 of this section, shall be paid upon submittal of the preliminary plan.
   b. As each phase is submitted for final plan approval, that percentage of the figure as determined based upon the letter of credit amount for the entire development, in accordance with the fee table set forth in subsection C1 of this section to which the value of the submitted phase corresponds, shall be paid prior to final plan approval for that phase.
   Example: Letters of credit amount for public improvements for entire development: $1,000,000.00.

   c. Should the actual letter of credit amount not be available at the time of submittal of the preliminary plan, the developer shall submit as a substitute therefor, an engineer's opinion of probable construction cost for the proposed public improvements for the entire development. Upon approval by the village engineer, such opinion shall be utilized as the basis for calculating the review fees. Such fees shall be adjusted in accordance with the letter of credit amount when finally determined. Should additional fees be required, they shall be apportioned equally to any remaining payments contemplated under the payment schedule set forth in subsection C2b of this section. If the final letter of credit amount is less than the initial estimate as submitted by the developer, the initial estimate shall be utilized unless the difference between the initial estimate and the final letter of credit amount is greater than twenty five percent (25%), in which case the village shall refund that amount of the difference in excess of twenty five percent (25%).
   D. Inspection Fees: All planned developments which contemplate the construction and/or dedication of public improvements shall have such improvements and/or utilities periodically inspected by the village engineer or his representative during the process of construction. The fee for such inspection services shall be determined based upon the amount of the letters of credit as required for the proposed public improvements in accordance with the following fee table:

   The above inspection fees shall be paid prior to final plat approval.
   E. Development Not Including Public Improvements: For planned developments which do not contemplate the construction and/or dedication of public improvements, review and inspection fees shall be charged to the developer as follows:
      1. Administrative fees shall be charged in amounts and in the same manner as set forth in subsection A of this section.
      2. Engineering review fees shall be charged at the hourly rate specified for work of this type in the consultant engineering contract between the village and the village engineer which is in effect at the time such fees are charged or at a rate as established by the village if review is conducted by authorized village personnel.
