5-7-6: ENFORCEMENT; PENALTIES:
   A.   Enforcement Officials: The village police department shall enforce the provisions of this chapter and may assess fines pursuant to subsection C of this section. (Ord. 1460, 1-22-2008)
   B.   Complaints: Any person may register a complaint with the department, a state certified local public health department, or the village police department. See 410 Illinois Compiled Statutes 82/40 for complaint procedure.
   C.   Violations; Fines:
      1.   A person, corporation, partnership, association or other entity who violates any provision of this chapter shall be fined pursuant to this subsection. Each day that a violation occurs is a separate violation. (Ord. 1460, 1-22-2008; amd. 2011 Code)
      2.   A person who smokes in an area where smoking is prohibited under this chapter shall be fined in an amount that is not less than one hundred dollars ($100.00) and not more than two hundred fifty dollars ($250.00). A person who owns, operates, or otherwise controls a public place or place of employment that violates this chapter shall be fined not less than two hundred fifty dollars ($250.00) for the first violation; b) not less than five hundred dollars ($500.00) for the second violation within one year after the first violation; and c) not less than two thousand five hundred dollars ($2,500.00) for each additional violation within one year after the first violation.    D.   Injunctions: The county department of public health, the village police department or any individual personally affected by repeated violations may institute, in a circuit court, an action to enjoin violations of this chapter. (Ord. 1460, 1-22-2008; amd. 2011 Code)
