5-5-3: BURNING OF LANDSCAPE WASTE:
The burning of landscape waste in the open air, under proper regulations shall be permitted so long as the same is not in conflict with the provisions of the acts of the state and its subsidiary agencies relative to the burning of landscape waste in open air.
It shall be lawful for residents of this village to burn leaves in the gutters of streets adjacent to their property provided that said street is not constructed of asphalt or any like material which would be damaged by said fire and further provided that said fire shall be tended at all times. In the event a person is accused of a violation in this paragraph and does not wish to contest said accusation, then said person so accused may pay to the police clerk at the police department of this village, a minimum fine of seventy five dollars ($75.00) within seven (7) days from the date of receipt of the citation (the date of issuance included) for and in full satisfaction of said violation.
