5-3-2: CONTAINER REQUIREMENTS:
   A.   Definition: For the purpose of this chapter, the words "collection day" shall mean the day advertised by the village as the next garbage and refuse collection day for the property of the owner or occupant.
   B.   Container Required: It shall be the duty of every owner, or his agent or occupant, of any house, building, flat, apartment or tenement where people reside, board or lodge in the village, or where animal or vegetable matter is prepared or served, to at all times maintain in good order and repair a receptacle for garbage and refuse, constructed in accordance with the provisions of subsection C of this section.
   C.   Specifications: Containers for residential garbage shall be either forty eight (48) gallon or ninety six (96) gallon capacity wheeled containers of the type supplied by the village of Milan. One container per household will be provided by the village of Milan for collection of residential garbage without charge. Additional containers may be provided by the village of Milan for a reasonable fee. In addition to a container for residential garbage as described above, each resident shall also be provided one approved either forty eight (48) gallon or ninety six (96) gallon capacity wheeled blue container for recyclable materials.
   D.   Yard Waste: Yard waste shall be placed in approved yard waste bags as provided at local retail stores and placed at the street curb line for pick up with a proper yard waste sticker affixed to each bag. Yard waste stickers shall be available for purchase from the village clerk for a reasonable fee.
   E.   Placement Of Residential Garbage Containers:
      1.   Residential garbage containers shall be placed at the street curb line on collection day in a location with three feet (3') of empty space on each side of the container. The placement of residential garbage containers at the street curb line more than twenty four (24) hours prior to collection day is hereby prohibited.
      2.   Recyclable containers shall be placed at the street curb line on collection day in a location with three feet (3') of empty space on each side of the container. The placement of recyclable containers at the street curb line more than twenty four (24) hours prior to collection day is hereby prohibited.
      3.   Yard waste bags shall be placed at the street curb line for pick up with a proper yard waste sticker affixed. (Ord. 1608, 8-18-2014)
