(A) The City Council may establish policies, rules and procedures for the adjustment of sewer service charges other than for water line leaks, on the basis that water passing through a customer's meter did not enter the city's sewer system.

(B) These policies, rules and procedures were adopted by the City Council and are hereby adopted by reference as if set out in full herein.

(A) The tap on fee for a sewer connection shall be based on the water meter size serving the connection as follows:

(B) The fees are in addition to the city's fees for water service connection and do not include the cost of materials, labor, and construction of the sewer connection. The cost of the labor and materials and the actual construction of the sewer connection is the responsibility of the property owner, and is subject to the approval of the city.

(A) Any user who shall violate any provision of this chapter, a discharge permit or other order issued hereunder shall be guilty of a violation of this chapter and shall be liable to the Superintendent for a civil penalty of at least $1,000 per violation for each day on which the violation occurs. Each day in which the violation occurs shall be deemed a separate offense.

(B) For violation of § 53.002, the fine upon conviction will be no less than $10 and no more than $100 for each offense, and each day's continuance thereof shall constitute a separate offense.

(C) Any user who violates § 53.133 shall be punished by a fine of at least $500 or by imprisonment for not more than 12 months or by both.

(D) Any industrial user who willfully or negligently violates any provisions of this chapter, any orders or permits issued hereunder, or any other pretreatment requirements shall, upon conviction, be guilty of a misdemeanor, punishable by a fine of not more than $500 per violation per day or imprisonment for not more than 1 year or both.
