§ 1840.06 AUTHORITY OF HEALTH COMMISSIONER TO TAKE ACTION; VIOLATIONS.
   (a)   The City Health Commissioner, or his or her authorized agent is hereby authorized to take any action that may be taken by the Board of Health as licensor under Ohio R.C. 3749.05 regarding the suspension of operation of a swimming pool or spa issued in accordance with Ohio R.C. Chapter 3749.
   (b)   The violations for which a suspension may be ordered are as follows:
      (1)   The grate or other covering for any main drain or other suction outlet is not properly in place and securely fastened.
      (2)   The disinfection system is not operable.
      (3)   The disinfection level falls below the minimum residual level required in OAC § 3701-31-07(4)(a).
      (4)   Insufficient water clarity, such that a swimmer, the main drain and/or a black disc, six inches in diameter, is not readily visible on the bottom of any public swimming pool or a special use pool.
      (5)   The required number of lifeguards are not provided as required in OAC § 3701-31-05(B)(1).
      (6)   The swimming pool or spa is missing any or all of the safety equipment as defined and required in OAC § 3701-31-05(F).
