(a) The annual City license fee for public swimming pools, public spas, and special use pools, as defined in Ohio R.C. 3749.01(G), (H) and (I), as provided by the regulations promulgated by the Public Health Council, shall be:

(b) The total cost of a license for a public swimming pool, public spa, and special use pool shall include an amount in addition to the fees set forth above, to be determined by the Public Health Council, pursuant to Ohio R.C. 3749.03 and 3749.04.
(c) Any licensee who fails to file a renewal application, postmarked by April 30, 2015 with the appropriate license fee, shall be assessed a penalty fee in the amount of 25% of the City license fee, pursuant to Ohio R.C. 3709.09.

(d) A Swimming Pool Fund is hereby established in accordance with Ohio R.C. 3749.04(E), and all monies collected under this section, except for twenty-five dollars ($25.00) of the annual fee for each license, which shall be transmitted to the State Treasurer, and except as otherwise provided in Ohio R.C. 3749.07(B), shall be deposited into this Fund. The fees deposited into said Fund shall be used solely for the purpose of administering and enforcing Ohio R.C. Chapter 3749 and any provisions of OAC 3701-31.

(e) Any person who violates any of the provisions of this regulation shall be in violation of, and subject to the penalties provided in Ohio R.C. 3749.99.
(f) This regulation shall be effective beginning December 1, 2014.
