§ 1604.99 PENALTY.
   (a)   Unless otherwise provided, whoever violates or fails to comply with any of the provisions of this chapter, including the provisions of the Middletown Fire Code and the Ohio Fire Code, as adopted in § 1604.01, and including any order of the Chief of the Division of Fire or his or her authorized representative made pursuant thereto, or builds in violation of any detailed statement of specifications or plans submitted and approved thereunder, or any certificate or permit issued thereunder, and from which no appeal has been taken, or fails to comply with such an order as affirmed or modified as provided in this chapter, within the specified time, is guilty of a misdemeanor of the second degree and shall be fined not more than seven hundred fifty dollars ($750.00) or imprisoned not more than 90 days, or both. The imposition of one penalty for any violation shall not excuse the violation or permit it to continue, and all such persons shall be required to correct or remedy such violation or defects within a reasonable time. When not otherwise specified, a separate offense shall be deemed committed each day that prohibited conditions are maintained or permitted to exist.
   (b)   The application of the penalty provided in division (a) hereof shall not be held to prevent the enforced removal of prohibited conditions.
