(a) All private swimming pools, spas and hot tubs, 24 inches or greater in depth or ten feet or greater in width or diameter shall be in conformity with the applicable requirements of this chapter. Portable pools less than 24 inches in depth and without electrical re-circulating devices that are under the surveillance and supervision of a responsible party at all times when filled shall be exempt.
(b) All materials and methods of construction used in swimming pools shall comply with the applicable requirements of the building code adopted in § 1402.01. Types of materials not contained in such Code shall be submitted to the Board of Building and Minimum Housing Standards for its approval.
