§ 1404.04 BUILDING PERMIT REQUIRED.
   (a)   No person shall construct, enlarge, alter or demolish a building or structure, or change the occupancy of a building or structure requiring strength, exitway or sanitary provisions, or change a building or structure to a prohibited use, or install or alter any equipment for which provision is made or the installation of which is regulated by the Ohio Building Code, without first obtaining the required permit therein, except that ordinary repairs, as defined in Chapter 4101:2-1-13(b) of the Ohio Building Code, which do not involve a violation of the Ohio Building Code, are exempt from this provision.

   (b)   No building permit or certificate of occupancy for a newly constructed single-family residential unit shall be issued unless the applicant submits evidence of an insurance backed warranty that provides:
      (1)   A one-year warranty for workmanship and material;
      (2)   A two-year warranty for major mechanical items; and
      (3)   A ten-year warranty for major structural defects, except as specifically permitted in this section.
   (c)   If the builder of a single-family residential unit intends to maintain ownership of the newly constructed unit for a period of three years or more from the date of the completion of construction, which such intent shall be evidenced by an affidavit in a form acceptable to the City, the builder shall not be required to obtain the warranties prescribed in division (b) of this section. However, if the builder transfers ownership of the property to another within three years of the date of completion of construction of the unit, the builder shall, at the time of transfer, provide the warranty described in division (b) of this section, if it is available at a commercially reasonable cost, which is hereby defined as an amount equal to or less than six percent of the purchase price of the property or ten thousand dollars ($10,000.00), whichever is less. If such warranty is not available at a commercially reasonable cost, the builder shall provide the purchaser with a standard whole-house warranty. The purchaser may waive this warranty only in writing, and such writing shall specifically refer to the requirements of this section and reference this section by number.
