§ 1050.21 DEFINITIONS.
   For the purposes of §§ 1050.20 through 1050.29, the following shall mean:
   (a)   BEST MANAGEMENT PRACTICES (BMPS). Schedules of activities, prohibitions of practices, maintenance procedures, and other management practices to prevent or reduce the pollution of surface waters of the State. BMPs also include treatment requirements, operating procedures, and practices to control runoff, spillage or leaks, sludge or waste disposal, or drainage from raw material storage.
   (b)   CLEAN WATER ACT. The federal Water Pollution Control Act (33 U.S.C. §§ 1251 et seq.), and any subsequent amendments thereto.
   (c)   DISCHARGER. Any person that allows or causes to allow a storm water or non-storm water discharge to enter the MS4 or a watercourse.
   (d)   DUMPING. Those illegal acts which are regulated by the City's Code Enforcement Section and Chapter 660 -Safety, Sanitation and Health.
   (e)   HAZARDOUS MATERIALS. Any material, including any substance, waste, or combination thereof, which because of its quantity, concentration, or physical, chemical, or infectious characteristics may cause, or significantly contribute to, a substantial present or potential hazard to human health, safety, property, or the environment when improperly treated, stored, transported, disposed of, or otherwise managed.
   (f)   HOUSEHOLD SEWAGE TREATMENT SYSTEM (HSTS). Any sewage treatment system, or part of such a system, for a single-family, two-family, or three-family dwelling that receives sewage.
   (g)   ILLEGAL DISCHARGE. Defined at 40 CFR 122.26(b)(2) and refers to any discharge to a municipal separate storm sewer that is not entirely composed of storm water, except discharges authorized under an NPDES permit (other than the NPDES permit for discharges from the MS4), discharges resulting from fire fighting activities, and discharges exempted in § 1050.23.
   (h)   ILLICIT CONNECTIONS. Any man-made conveyance connecting an illicit discharge directly to a municipal separate storm sewer.
   (i)   INDUSTRIAL ACTIVITY. Activities subject to NPDES Industrial Permits as defined in 40 CFR, Section 122.26 (b)(14) as well as Chapter 1041 of the Codified Ordinances (Wastewater Collection and Treatment).
   (j)   MUNICIPAL SEPARATE STORM SEWER SYSTEM (MS4). Municipal separate storm sewer system which means a conveyance or system of conveyances (including roads with drainage systems, municipal streets, catch basins, curbs, gutters, ditches, man-made channels, or storm drains) that are:
      (1)   Owned or operated by the federal government, state, municipality, township, county, district, or other public body (created by or pursuant to state or federal law) including special district under state law such as a sewer district, flood control district or drainage districts, or similar entity, or a designated and approved management agency under Section 208 of the Act that discharges into surface waters of the state; and
      (2)   Designed or used for collecting or conveying solely storm water, which is not a combined sewer, and which is not a part of a publicly owned treatment works.
   (k)   NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM (NPDES) STORM WATER DISCHARGE PERMIT.  A permit issued by EPA (or by a State under authority delegated pursuant to 33 USC § 1342(b)) that authorizes the discharge of pollutants to waters of the United States, whether the permit is applicable on an individual, group, or general area-wide basis.
   (l)   NON-STORM WATER DISCHARGE. Any discharge to the MS4 that is not composed entirely of storm water.
   (m)   OFF-LOT HOME SEWAGE TREATMENT SYSTEM (HSTS). A system designed to treat home sewage on-site and discharges treated wastewater off-lot.
   (n)   ON-LOT HOME SEWAGE TREATMENT SYSTEM (HSTS). A system designed to treat home sewage on-lot with no discharges leaving the lot.
   (o)   PERSON. Holds the same meaning as in Ohio R.C. 1.59 and also includes any state, any political subdivision of a state, and any department, division, board, commission, agency, or instrumentality of a state or political subdivision.
   (p)   POLLUTANT. Generally, any substance introduced into the environment that adversely affects the usefulness of a resource or the health of humans, animals, or ecosystems.
   (q)   POLLUTION. The man-made or man-induced alteration of the physical, biological, chemical, and radiological integrity of water and other media.
   (r)   PREMISES. Any building, lot, parcel of land, or portion of land, whether improved or unimproved, including adjacent sidewalks and parking strips.
   (s)   PRIVATE SEPARATE STORM SEWER SYSTEM. Privately-owned facilities by which storm water is collected and/or conveyed, including, but not limited to, roads with drainage systems, streets, gutters, curbs, inlets, piped storm drains, pumping facilities, retention and detention basins, natural and human-made or altered drainage channels, reservoirs, and other drainage structures.
   (t)   SEWAGE. Liquid waste containing animal or vegetable matter in suspension or solution that originates from humans and human activities. SEWAGE includes liquids containing household chemicals in solution commonly discharged from a residence or from commercial, institutional, or other similar facilities.
   (u)   STORM WATER. Defined at 40 CFR 122.26(b)(13) as storm water runoff, snow melt runoff, and surface runoff and drainage.
   (v)   STORM WATER POLLUTION PREVENTION PLAN. A document which describes the Best Management Practices and activities to be implemented by a person or business to identify sources of pollution or contamination at a site and the actions to eliminate or reduce pollutant discharges to storm water, storm water conveyance systems, and/or receiving waters to the maximum extent practicable.
   (w)   WASTEWATER. Any water or other liquid, other than uncontaminated storm water, discharged from a facility.
