§ 805.99 PENALTY.
   (a)   Owner or Person in Control. 
      (1)   Any owner or person in control of a premises who knowingly operates, participates in the operation or permits the operation of an adult entertainment establishment without a permit as required by this chapter is guilty of operating an adult entertainment establishment without a permit, a misdemeanor of the first degree, and shall be fined not more than one thousand dollars ($1,000) or imprisoned for not more than six months, or both, for each offense. A separate offense shall be deemed committed each day during or on which a violation or noncompliance occurs or continues.
      (2)   Any owner or operation of an adult entertainment establishment who violates this any portion of this Chapter while; a) operating an adult entertainment establishment under a permit issued under this Chapter, b) appealing a denied renewal application, or c) who is awaiting appeal while operating under a permit which has been revoked, is guilty of a misdemeanor of the fourth degree, and shall be fined not more than two hundred and fifty dollars ($250) or imprisoned for not more than 30 days, or both for each violation. A separate offense shall be deemed committed for each individual violation of this chapter and a separate offense shall be deemed committed for each day during which a violation or noncompliance continues.
   (b)   Employees, Agents and Independent Contractors of Adult Entertainment Establishments. Employees, independent contractors and agents who violate the provisions contained within § 805.14 shall be guilty of a minor misdemeanor, punishable by a fine of up to one hundred and fifty dollars ($150.00). A separate offense shall be deemed committed for each individual violation of § 805.14 and a separate offense shall be deemed committed for each day during which a violation or noncompliance continues.
   (c)   Patrons of Adult Entertainment Establishments. Patrons of adult entertainment establishments who violate § 805.14 (e) (6) by commingling or touching entertainers shall be guilty of a minor misdemeanor, punishable by a fine of up to one hundred and fifty dollars ($150.00). A separate offense shall be deemed committed for each individual violation of this section.
