(a) The City of Middletown Public Works & Utilities Director, or the Director’s designee, is authorized to oversee public parking lots owned and maintained by the City in which the public may park vehicles in marked parking spaces subject to the restrictions set forth in this Chapter 452. The Director shall have the authority to establish, implement and enforce rules, as the Director deems necessary, to carry out the spirit and intent of this § 452.15.
(b) No person shall park any vehicle in a City parking lot:
(1) In such a manner that it is not entirely within the marked boundaries of a single parking space;
(2) In such a manner that the vehicle obstructs the safe passage of other vehicles or pedestrians in the parking lot, or obstructs another vehicle’s access to any other designated parking space in the lot;
(3) In a designated parking space in violation of any posted restrictions applicable to such space regarding hours, time limits, parking reserved for use by certain individuals, or any other restriction;
(4) In a parking space designated as “permit-only” parking without prominently displaying the required permit on the dashboard or hanging from the rearview mirror of the vehicle; or
(5) In any other manner violative of any federal, State, or local law or regulation, including but not limited to any provision of Chapter 452 of the Codified Ordinances of the City of Middletown.
(c) The City of Middletown Public Works & Utilities Director is authorized to designate in any City parking lot parking spaces for the parking of vehicles belonging to operators, employees or patrons of business establishments or offices, or residents of residential buildings, located in the vicinity of the lot. The following regulations shall apply to parking spaces so designated by the Public Works & Utilities Director:
(1) The Public Works & Utilities Director shall cause signs to be posted in the parking lot notifying the public which parking spaces in the lot are designated for use by operators, employees or patrons of a business establishment or office, or residents of certain residential buildings. Where a parking space is designated for use by operators, employees or patrons of a particular business establishment or office, or residents of a particular building, only persons falling within the designated category are permitted to use such parking space. Cost of the production of the sign for the designated spaces shall be borne by the permit holder.
(2) The Public Works & Utilities Director may restrict the dates and times on which designated parking spaces may be used by an operator, employee or patron of a business establishment or office, or resident of a particular building. The Director shall coordinate with the business, office, or residential building served by a parking space to establish restrictions which are not inconsistent with the unique needs of the business, office, or building.
(3) The Public Works & Utilities Director may impose reasonable fees for the use of designated parking spaces by business establishments, offices, and residential buildings. Such fees shall be determined at the discretion of the Director, taking into account the size of the parking lots and number of parking spaces designated for use by the business establishment, office, or building.
(4) The Public Works & Utilities Director may issue special parking permits for operators or employees, or residents, to park in parking spaces designated for use by the business, office, or building. The price of any such special parking permit shall be established annually by City Council. An operator, employee, or resident with permission to park in a designated parking area pursuant to an authorized special parking permit may only park his vehicle in a designated parking space when the requisite special parking permit is prominently displayed on the dashboard or hanging from the rearview mirror of the vehicle. Operators, employees, and residents must park their vehicles in compliance with all applicable parking regulations, including but not limited to any time limit or overnight parking restrictions.
(5) Designated parking spaces or special parking permits for individual use in City parking lots may be revoked at the discretion of the Public Works & Utilities Director if the business establishment, office, or residential building served by such designated parking, or individual in possession of a special parking permit, violates any federal, State, or local law or regulation in using a designated parking space, or the Director otherwise deems revocation necessary in the interests of the public health, safety, or general welfare.
(d) Box-style trucks, trailers, semitrailers and commercial trailers shall be prohibited from parking in any City parking lot without the express written consent of the City. This prohibition includes mobile food vending units as defined in § 1037.01 of the Codified Ordinances of the City of Middletown.
