(a) Generally. Notwithstanding the provisions of Sections 408.01 and 408.02
, any person who has violated the provisions of any section of this Traffic Code, other than those offenses specified in Rule 13(B) of the Rules of Practice and Procedure in Traffic Cases for All Courts Inferior to Common Pleas, effective January 1, 1975, as amended, upon executing before and filing with the Mayor's Court an instrument waiving the formal issuance of an affidavit and warrant together with the reading of such affidavit and the right to be present personally at the trial of such action, and further waiving the right of appeal and error and authorizing a plea of guilty to be entered and the defendant submitted to the mercy of the court, may be fined such sum as may be fixed by the Mayor, not exceeding the maximum amount prescribed by Section 408.01, unless, in the opinion of the Chief of Police or the Mayor, such violation is of such nature that the facts should be presented to the Court for consideration and sentence, in which event a waiver shall not be accepted.

(b) Violations of Chapter 451 (Parking Generally).
(1) Except as otherwise provided in this division (b), any person who is cited for a violation of any of the provisions of Chapter 451 (Parking Generally) may appear at the Police Station within 72 hours of the time appearing on such citation and enter a plea of guilty and pay a waiver fine of fifteen dollars ($15.00). After the expiration of the 72-hour period, any person so cited may appear at the Police Station and enter a plea of guilty to such charge and pay a waiver fee of twenty-five dollars ($25.00), provided a summons has not been issued for such person or a warrant issued for the arrest of such person. In the event of the issuance of a summons or warrant, the matter shall be docketed in the Berea Municipal Court and the penalties shall be as provided in Sections 408.01 and 408.02.
(2) Any person who is cited for a violation of Section 451.06 may appear at the Police Station within 72 hours of the time appearing on such citation and enter a plea of guilty and pay a waiver fine of fifty dollars ($50.00). After the expiration of the 72-hour period, any person so cited may appear at the Police Station and enter a plea of guilty to such charge and pay a waiver fine of seventy-five dollars ($75.00), provided a summons has not been issued for such person or a warrant issued for the arrest of such person. In the event of the issuance of a summons or warrant, the matter shall be docketed in the Berea Municipal Court and the penalties shall be as provided in Sections 408.01 and 408.02.

(c) Whoever violates Section 451.03(w) is guilty of a misdemeanor and shall be fined one hundred fifty dollars ($150.00). If the offender previously has been convicted of a violation of Section 451.03(w), then the offender shall be fined not less than two hundred fifty dollars ($250.00) nor more than five hundred dollars ($500.00) for each subsequent offense.
