(a) Noise Source Emitted from a Commercial, Industrial, Public-Institutional or Planned Mixed Use Zoning District. No person or entity located in any Commercial, Industrial, Public-Institutional, or Planned Mixed Use Zoning District shall create or cause to be emitted from their person or from any stationary noise source any noise that causes or results in a noise level equal to or exceeding 60 dBA measured at any lot line of any adjacent lot located in any zoning district, with the exception of an adjacent Residential Zoning District or adjacent Public- Institutional Zoning District.
(b) Noise emitted from a generator operated by a public utility, government, or any agencies thereof, as a temporary emergency substitute for electrical power, including periodic testing of such generator, is not a violation of division (a) of this section.
(c) Whoever violates division (a) of this section is guilty of a minor misdemeanor for a first offense and a misdemeanor of the second degree for any subsequent offense.
