(a) The person, firm or corporation duly appointed by the City as its City Engineer is hereby prohibited, and all other members or employees of such individual, firm or corporation appointed as such City Engineer are hereby prohibited, from performing any engineering or surveying services in connection with land development, subdivision, building design, structure design, site location or any other improvement falling within the authority of a civil, electrical or mechanical engineer, located or to be located within the City. Such prohibition shall not, however, apply to private surveying work that does not require approval in any manner by the City, its agents or employees. In addition, such prohibition shall not apply to work specifically authorized to be done by the City Engineer upon motion or resolution of Council and approval of the Mayor.
(b) The person, firm or corporation duly appointed by the City as its City Engineer, and all other members or employees of such individual, firm or corporation appointed as such City Engineer, shall not be elected or appointed as the principal City Engineer of any city contiguous to the City of Middleburg Heights.
