SECTION 14.05   MANDATORY ELECTION FOR RESIDENTIAL BUILDINGS IN EXCESS OF THIRTY-FIVE FEET.
   No legislation or variance which permits or allows the construction or occupancy, for residential purposes, of a building in excess of thirty-five (35) feet in height, excluding mechanical equipment and decorative fixtures, shall become effective, nor shall any building or occupancy permit be issued pursuant thereto until the said legislation or variance has been submitted to the electorate of the City for approval or disapproval. Such election shall be had at the first election occurring on the first Tuesday after the first Monday in May or on the first Tuesday after the first Monday in November occurring more than 60 days subsequent to final action by Council or any appropriate board or commission. Approval of such action by a majority of the electors voting thereon is mandatory prior to the taking effect of such legislation or variance.
