(a) Organization. The Civil Service Commission shall consist of three (3) electors of the Municipality not holding other municipal office or appointment, to be appointed by the Mayor with the approval of a majority of the members of Council. Each shall serve for a term of six (6) years, except that one of the three electors first appointed shall be designated by the Mayor to serve for a term of two years, and one for a term of four years, all commencing January 1, 1971. A vacancy occurring during the term of any member of the Commission shall be filled for the unexpired term by the Mayor with the approval of a majority of the members of Council. No member shall be appointed to consecutive terms.
(b) Officers. The Commission shall designate one (1) of its members as chairman and may appoint a secretary who need not be a member of the Commission and may hold other municipal office or appointment.
(c) Compensation and Funds. Members of the Civil Service Commission shall serve without compensation unless otherwise provided by ordinance. A sufficient sum shall be appropriated by the Council to carry out the civil service provisions of this Charter.
(d) Powers and Duties. The Commission shall make, promulgate and, where necessary, amend rules, including, without limitation thereof, those for ascertainment of merit and fitness, for the appointment, promotion, transfer, layoff, reinstatement, suspension and removal of employees in the classified service of the Municipality as required by the Constitution of the State of Ohio, and for appeals from the action of the Director of Public Safety in case of transfer, reduction or removal except as otherwise provided in this Charter.
The Commission shall keep a record of its proceedings and examinations, which shall be open to public inspection and, in all matters not in conflict with this Charter, shall conduct its affairs in accordance with the provisions of the General Law. The Commission shall certify payrolls of employees in the classified service in accordance with the General Laws of Ohio.
(e) Classification of Service. The Civil Service of the Municipality is hereby divided into the unclassified and classified service.
The classified service shall include only: All firemen and policemen, excluding the Fire Chief and Police Chief.
