SECTION 4.10   LEGISLATIVE PROCEDURE.
   All legislative action shall be by ordinance or resolution except when otherwise required by the Constitution or the laws of the State of Ohio, but departmental procedure and administrative matters may be transacted by motion recorded on the journal.
   Copies of a proposed ordinance or resolution in as complete form as possible shall, at least five days prior to its introduction, be delivered personally to or left at the usual place of residence of each member of Council and be posted in the City Hall. There shall be no authority to dispense with this rule except by a two-thirds vote of the members of Council, taken by yeas and nays and entered on the journal, when it is determined necessary to take immediate action on proposed legislation. The Clerk of Council's certificate as to the giving of such notice shall be conclusive and the failure of delivery or posting shall not invalidate any ordinance or resolution.
   Every ordinance or resolution concerning the granting, renewing or extension of a franchise, or the enactment, amendment, or repeal of any zoning ordinance, or the fixing or regulation of the rate charged by a public utility for its services, or the change in boundaries of the Municipality or its wards, shall be read at three (3) different Council meetings by title only unless at least two (2) members of Council request it to be read in its entirety. Any other ordinance or resolution shall require only one reading by title only unless at least two (2) members of Council request it to be read in its entirety.
   On the passage of every ordinance or resolution, the vote shall be taken by yeas and nays and each Councilman's vote shall be entered on the journal. No ordinance or resolution shall be passed without the affirmative vote of a majority of the members of Council.
   All ordinances, resolutions, statements, orders, proclamations, notices and reports, required by law or by this Charter to be published, shall be posted in the City Hall and in the Middleburg Heights Library for a period of not less than fifteen (15) days prior to the taking effect thereof, or in such other manner as Council may hereafter determine by ordinance. Ordinances and resolutions taking effect immediately upon their passage and approval by the Mayor shall also be posted as aforesaid, but said requirements for posting shall not postpone the effective date of such legislation.
