If addition to any warranties provided in the Ohio Revised Code, in every sale of realty to which this chapter applies, the seller of the condominium unit shall warrant, or be presumed to have warranted, that the condominium unit and common areas of the condominium property are in compliance with the Building Code, the Zoning Code and other applicable ordinances of the City at the time of the contract of sale, unless the seller has obtained and presented to the buyer a copy of a certificate of inspection or a copy of a certificate of compliance, where required in this chapter, or unless the buyer has actual knowledge of the deficiencies or violations in the condominium unit and common areas at the time of the contract of sale, or unless the Director of Building and Zoning, upon application, has failed to issue the appropriate certificate of inspection or certificate of compliance within the time prescribed in this chapter.
