1347.02 LICENSE AND BOND REQUIRED.
   (a)   No person shall contract, either orally or in writing, for the planning, planting, sale and/or installation of trees, shrubs, flowers, bulbs, lawns, grasses, groundcovers and the like, involving the grading or drainage of a lot, without first obtaining a license, providing a cash bond for each and every lot which will be the subject of the landscapers' activity, in the amount of one hundred dollars ($100.00), and paying the fees provided herein. The cash bond shall be refunded thirty days following inspection by the Building and Zoning Director and his finding that the installation of the landscaping facilities is satisfactory.
   (b)   No occupancy permit shall be issued unless one of the two following conditions has been satisfied:
      (1)   The landscaping facilities have been installed according to the landscape plan.
      (2)   A cash bond has been submitted to the Building Department, in an amount which the City Planner determines to be sufficient, to insure completion of any uncompleted portion of the landscape plan.
   (c)   In the event the landscaping plan is not completed within the time provided by the Building and Zoning Director or the Planning Commission, such bond shall be forfeited and applied toward the cost of installing or finishing said landscape plan. In the event that the landscaping is completed according to plan within the allotted time, the cash bond will be refunded. (Ord. 1989-131. Passed 12-26-89.)
