1323.04 GRADE REQUIRED FOR BUILDING PERMIT.
   (a)   The yard grade and elevation of the first floor joist plate as determined by the Engineer shall become a part and condition of the building permit issued by the Building and Zoning Director for the proposed building or structure, and the building or structure shall conform and be constructed in accordance with these conditions. The owner and/or contractor shall not continue with the construction of the building until an inspection is made by the Engineer of the footer forms prior to pouring of the footer, of the completed foundation, of the first floor joist plate and of the final grade. If upon each inspection by the Engineer it is found that such construction conforms to the approval granted, then permission will be given to proceed. If, however, the owner and/or contractor has varied from the established grade and plate elevation, then the owner and/or contractor must pay an additional permit fee of one hundred ninety dollars ($190.00). He or she must then make the necessary corrections to conform to the established grade and plate elevation before any further work will be permitted.

   (b)   The Engineer shall also inspect the yard grade after completion of landscaping and shall verify that it conforms to the established grade. In the event that the Engineer determines upon final inspection after landscaping that the owner and/or contractor has varied from the established grade, the owner and/or contractor shall make the necessary corrections to conform to the established grade.
