1323.03 METHOD OF ESTABLISHING GRADE.
   Yard grades are to be established throughout the Municipality by the Engineer. The Engineer will be paid for his or her services at the rate of three hundred eight dollars ($308.00) per yard grade and at the rate of eighty dollars ($80.00) for reinspection per yard grade required because of nonconformity by the owner and/or contractor.
   In establishing the yard grade the Engineer shall take the following factors into consideration:
   (a)   The overall area grading plan;
   (b)   The grade of the streets on which the lot or the land exists; in the event that the street is not then in existence, the grade of the street as proposed;
   (c)   The existing grade and/or contour of the lot and/or contour of adjacent properties;
   (d)   The setback and location of the proposed building or structure on the lot;
   (e)   Any other physical factors usually considered in conformity with good engineering and construction practices.
   The Engineer shall indicate the yard grade as determined by him or her by means of suitably marked stakes set near the property sideline at locations to be determined by the Engineer. The Engineer shall in addition, indicate the yard grade or other reference mark on some nearby fixed object such as a telephone pole or fireplug. The Engineer shall also pick and approve the elevation of the first floor joist plate of the proposed building or structure, in accordance with the plans submitted by the owner and/or contractor. Such elevation shall not be in excess of 24 above the highest point of the yard grade at the building as established by the Engineer except in the case of split level designed houses, in which event such elevation shall not be in excess of 48 inches above the highest point of the yard grade.
