(a) Whoever violates any of the provisions of this chapter, or fails to comply with any notice issued pursuant to this chapter, shall be fined not more than five hundred dollars ($500.00) for each offense. A separate offense shall be deemed committed each day during or on which a violation occurs or continues.
(b) If, as the result of a violation of any of the provisions of this chapter, the injury, mutilation or death of a tree is caused, the cost of repair or replacement of such tree shall be born by the party in violation. The replacement value of trees shall be determined in accordance with the latest edition of “Valuation of Landscape Trees, Shrubs and Other Plants,” as published by the International Society of Arboriculture.
