904.12 REMOVAL AND REPLACEMENT OF PUBLIC TREES FOR CONSTRUCTION OR OTHER REASONS.
   (a)   Whenever it is necessary to remove a public tree in connection with the paving of a sidewalk or the widening of a portion of a street or highway, the City shall cause said tree to be replanted or to be replaced with a species included on the list of desirable trees referred to in Section 904.06. This requirement will be satisfied if an equivalent number of trees are planted at the nearest appropriate location, as determined by the Department of Public Service.
   (b)   No person shall remove a public tree for the purpose of construction or for any other reason without the written permission of the Department of Public Service. The Department may require replacement of a removed tree as a condition of approval. Such replacement shall be in accordance with the lists referred to in Section 904.06. The person or property owner shall bear the cost of removal and replacement of all public trees removed.
