(a) The City shall have the right to plant, prune, maintain and remove all public trees as may be necessary to insure public safety or to preserve or enhance the symmetry and beauty of public sites. The Department of Public Service may remove, or cause to be removed, any public tree or part thereof which is in an unsafe condition or which, by reason of its nature, is injurious to sewers, electric power lines, gas lines, water lines or other public improvements or is infected with any injurious disease, insect or fungus.
(b) This section does not prohibit the planting of a tree along a street by a property owner, provided that the selection of said tree and the planting thereof are in accordance with Sections 904.06 through 904.10. No property owner shall plant a tree within a right of way without first obtaining the written approval of the Department of Public Service.
