§ 114.28 LICENSE FEE.
   Food purveyors are hereby divided into classes, and the annual license fee for each class is as follows:
   (A)   Class I. This class shall include establishments which handle food products but do not sell raw or fresh meats, fish, poultry or game, or any meat products or meat preparations other than such as are contained and sold in cans, bottles, boxes, cartons, or similar containers. The annual license fee for this class shall be $5;
   (B)   Class II. This class shall include meat markets, poulterer's and fishmonger's shops, establishments operating upon the self-help basis where the buyer helps him or herself to his or her purchases without a clerk, and shall also include all food purveyors establishments not falling under Classes I or III. The annual license fee for this class shall be $5;
   (C)   Class III. This class shall include fruit or vegetable stores and establishments selling smoked, salted, pickled, or boiled meats or meat products, fruits, vegetables, or other food products commonly sold in delicatessen stores, but not selling any raw or fresh meats, fish, poultry, or game. The annual license fee for this class shall be $5;
   (D)   Only one license required; provided, however, that where a licensee conducts or operates more than one of the three classes established hereunder he or she shall be required to procure but one license, and the license shall be of the class that requires the payment of the highest license fee under this section; and
   (E)   The number of persons engaged shall be the number engaged in selling to the trade or in the making or the manufacture of products sold in such establishments.
