§ 114.01 DEFINITIONS.
   For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   RETAIL. The sale in small quantities directly to the consumer.
   RETAIL FOOD ESTABLISHMENT. 
      (1)   Any building, room, stand, enclosure, place, or establishment occupied and used as a place of business by food purveyors, food dispensers, and any other such place maintained or operated for the purpose of selling, offering for sale, or keeping with the intention of selling or distributing at retail any cooked or uncooked article of food, drink, confection, or condiment used or intended to be used for human consumption; provided, that the provisions of this subchapter regulating and licensing any retail food establishment shall not be construed as repealing, modifying, or in any way conflicting with the provisions contained in the sections of this code, hereinafter in this section enumerated.
      (2)   The sections of this code and the subject matter of the same not affected by the provisions of this subchapter regulating food establishments are as follows:
         (a)   Chapter 113, concerning peddlers, hawkers, itinerant merchants, and transient vendors of merchandise.
         (b)   Sections 114.65 et seq. concerning vehicles carrying foodstuffs.
      (3)   Provided, further, that to the extent that sanitary and health regulations for handling foods are prescribed herein, they shall relate to and be effective in the case of the various businesses, occupations, foods, and food products enumerated in the preceding proviso, where they do not conflict with the regulations regarding the same.
