§ 110.01 DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   ALCOHOLIC LIQUOR. Any spirits, wine, beer, ale, or other liquid containing more than .5% of alcohol by volume, which is fit for beverage purposes.
   BED AND BREAKFAST ESTABLISHMENT. An operator-occupied residence providing accommodations for a charge to the public with no more than 12 guest rooms for rent and which operates for more than ten nights in a 12-month period.
   BEER AND ALE. A fermented alcoholic grain, barley, or malt beverage less than 10% alcohol by weight.
   BREW PUB. A micro-brewery that sells at retail some portion of its production for off-premises consumption.
   CATERER RETAILER. A person who serves alcoholic liquors for consumption, either on-site or off-site, whether the location is licensed or unlicensed, as an incidental part of food service. Prepared meals and alcoholic liquors shall be sold at a package price agreed upon under contract.
   CLUB. A corporation organized under the law of this state, not for pecuniary profit, solely for the promotion of some common object other than the sale or consumption of alcoholic liquors, kept, used and maintained by its members through the payment of annual dues, and owning, hiring or leasing a building or space in a building, of such extent and character as may be suitable and adequate for the reasonable and comfortable use and accommodation of its members and their guests, and provided with suitable and adequate kitchen and dining room space and equipment and maintaining a sufficient number of servants and employees for cooking, preparing and serving food and meals for its members and their guests; provided, that such club files with the Local Liquor Control Commissioner at the time of its application for a license under this chapter two copies of a list of names and residences of its members, and, provided further, that its affairs and management are conducted by a board of directors, executive committee, or similar body chosen by the members at their annual meeting and that no member or any officer, agent or employee of the club is paid, or directly or indirectly receives, in the form of salary or other compensation any profits from the distribution or sale of alcoholic liquor to the club or the members of the club or its guests introduced by members beyond the amount of such salary as may be fixed and voted at any annual meeting by the members or by its board of directors or other governing body out of the general revenue of the club.
   DISTILLER. A person who distills, ferments, brews, makes, mixes, concocts, processes, blends, bottles or fills an original package with any alcoholic liquor. A distiller may make sales and delivery of alcoholic liquor to distillers, rectifiers, importing distributors, distributors and non-beverage users, but not to other retail licensees.
   HOTEL. Every building or other structure kept, used, maintained, advertised, and held out to the public as a place where food is actually served and consumed and sleeping accommodations are offered for adequate pay to travelers and guests, whether transient, permanent, or residential, in which 12 rooms or more are used for sleeping accommodations for such guests.
   LOCAL LIQUOR CONTROL COMMISSIONER. The Mayor of the City of Metropolis who is charged with the administration within the jurisdiction of the city by state statute and who shall have such powers and perform such other and further duties in addition to the receipt of license fees as are provided by law; provided, however, if the Mayor shall have an interest in the manufacture, sale, or distribution of alcoholic liquor, he or she shall direct the City Council to appoint, by majority vote, a person other than the Mayor who fulfills the requirements of Section 4-2 of the Illinois Liquor Control Act of 1934, as amended (ILCS Ch. 235, Act 5, § 4-2) to be the LOCAL LIQUOR CONTROL COMMISSIONER. Such appointment shall be made within 30 days from when the Mayor takes office.
   MICRO-BREWERY. A brewery producing not more than 100,000 gallons of beer or ale per year and shall be considered a manufacturing operation.
   ORIGINAL PACKAGE. Any bottle, jug, flask, can, cask, barrel, keg, hogshead, or other receptacle or container whatever, corked, or capped, sealed, and labeled by the manufacturer of alcoholic liquor, to contain and convey any alcoholic liquor.
   OWNER or PROPRIETOR. Shall include all persons who are owners or are in control of any place where the sale or distribution of alcoholic liquor is carried on whether they are individuals, partnerships, corporations, joint stock companies, limited liability companies, fiduciaries, or officers, directors, managers, members, general partners, or otherwise.
   PACKAGE LIQUOR STORE. Any establishment catering to the general public whose principal business is the sale of alcoholic liquors, not for consumption on the premises, but may, with the proper video gaming licenses, be permitted to sell alcoholic liquor for consumption on the premises.
   PLACE OF AMUSEMENT. Any public place whose primary function is to provide entertainment or recreation to its patrons. PLACES OF AMUSEMENT shall include bowling alleys, billiard halls, arcades, theaters, gyms, exhibition halls, museums, dance halls, or venues, arenas, stadiums, fitness centers, or other similar places. PLACES OF AMUSEMENT may be licensed as restaurants provided they maintain kitchens fully equipped and licensed by the Public Health Department and employ persons licensed by the Public Health Department to prepare and serve food to the public and further provided they maintain a dining room where meals are regularly sold; otherwise they shall be licensed only for on-premise alcohol consumption as provided in § 110.10(J).
   RESTAURANT. Any public place kept, used, and maintained, advertised, and held out to the public as a place where meals are served, and regularly served, without sleeping accommodations, such place being provided with adequate and sanitary kitchen licensed or approved by the Public Health Department and dining room equipment and capacity and having employed therein a sufficient number of employees, licensed or approved by the Public Health Department, to prepare, cook, and serve food for its guests.
   RETAIL SALE. The sale for use or consumption and not for resale.
   WINE. Any alcoholic beverage obtained by the fermentation of the natural contents of fruits or vegetables, containing sugar, including such beverages when fortified by the addition of alcohol or spirits.
