Any handgun or other weapon that will be carried by a private security officer shall be registered with the Chief of Police and subject to such tests as the Chief prescribes. No private security officer shall carry a handgun or other weapon while on duty as a private security officer unless he or she has first obtained a certificate pursuant to Ohio R.C. 109.78 or completed twenty years of active duty as a peace officer, as defined in Ohio R.C. 109.71.

(a) The Chief of Police is hereby authorized to prescribe such uniform, badge and/or distinguishing uniform marks for a private security officer as he may see fit in order to distinguish such private security officer from a regular police officer of the City.
(b) No person who is not a member of the Police or Fire Department of the City shall wear a uniform, cap, badge or buttons similar to, or in imitation of, the official uniform in use at the time by the members of such Departments. The use of police blue is prohibited unless specifically authorized by the Chief of Police.

Every private security officer shall provide, along with his or her application for registration as a private security officer, proof that he or she is insured by a policy or policies of comprehensive general liability insurance in an amount of at least five hundred thousand dollars ($500,00) for any and all claims for bodily injury and property damage arising out of his or her activities as a private security officer or activities incidental or related thereto. Such policy of insurance shall name the City as an additional insured thereon.

Every private security officer, his or her employer and the owner of the premises where the private security officer is to perform his or her duties shall agree to indemnify and hold harmless the City and its agents, servants and employees against any and all claims arising out of such officer's activities as a private security officer or activities incidental or related thereto.

No person shall employ a private security firm, private security officer, night watchman or guard in the City without first advising the Chief of Police and determining that such firm, officer, night watchman or guard is commissioned by the City.

Whoever violates any of the provisions of this chapter is guilty of a minor misdemeanor on a first offense and a misdemeanor of the first degree on a second or subsequent offense. Punishment shall be as provided in Section 698.02. A separate offense shall be deemed committed each day during or on which a violation occurs or continues.
