1-4-5: CITATIONS AND DEPOSITS, GENERALLY:
   A.   Citation Method Of Enforcement: Pursuant to the authority of section 66.0113, Wisconsin statutes, the city hereby elects to use the citation method of enforcement of ordinances, including ordinances for which a statutory counterpart exists.
   B.   Citation Contents And Form:
      1.   The citation shall contain the following:
         a.   The name and address of the alleged violator.
         b.   Factual allegations describing the alleged violation.
         c.   The time and place of the offense.
         d.   The section of the ordinance violated.
         e.   A designation of the offense in such manner as can readily be understood by a person making a reasonable effort to do so.
         f.   The time at which the alleged violator may appear in court.
         g.   A statement which, in essence, informs the alleged violator: (1975 Code Ch. 1 § V)
            (1)   That a cash deposit based on the schedule established by section 1-4-6 of this chapter may be made which shall be delivered or mailed to the Dunn County Clerk of Courts prior to the time of the scheduled court appearance. (1975 Code Ch. 1 § V; amd. 2009 Code)
            (2)   That if a cash deposit is made, no appearance in court is necessary unless subsequently summoned.
            (3)   That if a cash deposit is made and the alleged violator does not appear in court, the nonappearance will be deemed a plea of no contest for which a forfeiture not to exceed the amount of the deposit is submitted, or, if the court does not accept the plea of no contest, a summons will be issued for the alleged violator to appear in court to answer the complaint.
            (4)   That if no cash deposit is made and the alleged violator does not appear in court at the time specified, an action may be commenced to collect the forfeiture up to the maximum permitted by law.
         h.   A direction that if the alleged violator elects to make a cash deposit, the statement which accompanies the citation shall be signed to indicate that the statement required under subsection B1g of this section has been read. Such statement shall be sent or brought with the cash deposit.
      2.   The form of the citation shall be uniform and used by all law enforcement officers and other City officials.
   C.   Issuance Of Citations: Any law enforcement officer may issue citations for enforcement of any codes authorized under this chapter. In addition, the following officials of the City are hereby authorized to issue citations for enforcement of those laws specified only. Such officials may delegate this authority to their subordinates upon approval by the Common Council. (1975 Code Ch. 1 § V)

      5-1-3F, fireworks regulations
      5-1-4B1 and B2, tampering and obstructing passageways
      5-1-7, false alarms, false reports
      Title 9, chapter 3, fire limits and Fire Code
      2.   Health Officer:
      Title 3, chapters 3 and 4, intoxicating or fermented malt beverage establishments
      3-4-4, dancing in beer and liquor licensed establishments
      Title 3, chapters 16 and 17, campgrounds and mobile home parks
      4-1-1, sale of unprocessed agricultural products
      5-1-4A2, littering or depositing of refuse (1975 Code Ch. 1 §V; amd. 2009 Code)
      3.   Chief building inspector:
      Title 2, chapter 8, Historic Preservation Commission
      Title 2, chapter 9, urban forestry
      Title 4, chapter 3, solid fuel fired outdoor heating devices
      5-1-8, prohibited parking of mobile equipment
      7-1-7, opening streets and replacing surfacing
      Title 7, chapter 2, sidewalk, driveway, curb and gutter installation
      Title 9, building regulations
      Title 10, zoning regulations
      Title 11, extraterritorial zoning
      Title 12, floodplain zoning
      Title 13, shoreland-wetland zoning

   D.   Procedure: The provisions of section 66.0113(3), Wisconsin Statutes, relating to violator's options and procedure on default are hereby adopted and incorporated herein by reference.
   E.   Nonexclusivity: Adoption of this chapter in no way precludes the adoption of any other chapter or section, or providing for the enforcement of any other law relating to the same or any other matter. The issuance of a citation under this chapter in no way precludes the proceeding under any other law relating to the same or any other matter. (1975 Code Ch. 1 § V; amd. 2009 Code)
