4-1-2: DEFINITIONS:
   JUNK: All discarded articles or manufactured articles no longer used for the purpose for which they were manufactured, including, but not limited to, old or rusting, dismantled or nonoperating motor vehicles 1 , metal, chain, rope, cordage, bags, paper, rubber, glass or plastic.
   NUISANCE:
   A.   Anything defined as such by the Idaho Code, as its sections and subsections may be amended from time to time.
   B.   Junk, trash or secondhand articles which are visible from the real property of the city, from the streets or sidewalks within the city, or visible from the property of anyone who does not own the junk, trash or secondhand articles.
   C.   Any condition or use of a premises or property which:
      1.   Creates a fire hazard, including, but not limited to, the presence of weeds, tall grass or trash 2 .
      2.   Is offensive to the senses or is deemed an eyesore.
      3.   Is injurious to health.
         a.   The mayor and city council may consider whether state or federal health laws or regulations have been violated when making this determination.
         b.   Repeated acts of violence or excessive noise occurring on or about a private residence or place of business in the course of one calendar year, whether reported or unreported to city or county officials, shall constitute a nuisance as follows:
            (1)   Private Residence: If more than one incident of violence or excessive noise is caused by either an owner or occupant of the residence, such shall constitute a nuisance.
            (2)   Business: If more than one act of violence is directed toward a patron or client of the business establishment, and if physical harm comes to a client or patron of the business establishment, such shall constitute a nuisance.
      4.   Violates state or federal safety laws or regulations.
      5.   Violates federal or state criminal laws, as such may be amended from time to time, including, but not limited to, laws dealing with illegal drugs, controlled substances or prostitution.
      6.   Is otherwise injurious to the health, safety and welfare of the inhabitants of the city.
   PERSON: Shall include any human, and any firm, partnership, association, institution, company, corporation or organization of any kind.
   SECONDHAND ARTICLES: Includes anything which is discarded or is no longer being used, but which still possesses utility in its present state for the purposes for which it was originally intended or manufactured.
   TRASH: Junk having no market value, unused or discarded parts of dead animals or vegetation (including, but not limited to, any dead plant life such as tree branches, cut grass, wood scraps and any other valueless refuse). (Ord. 122, 8-26-1987)
