(a) No person shall knowingly solicit, request, command, or induce another to sell, barter, exchange, donate, give or otherwise transfer or deliver any drug of abuse as defined in Ohio R.C. 3719.011(A), controlled substance as defined in Ohio R.C. 3719.01(D), dangerous drug as defined in Ohio R.C. 4729.02(D)(1), (2) or (3), or marihuana as defined in Ohio R.C. 3719.01(P), to that person or another.
(b) This section does not apply to the following:
(1) Peace officers or federal law enforcement officers acting in the lawful discharge of their duties; or
(2) Any person seeking to obtain a controlled substance pursuant to a prescription legally issued to such person; or
(3) Those listed in Ohio R.C. 2925.03(B)(1), (2) and (3).
(c) Whoever violates this section is guilty of controlled substance solicitation, a misdemeanor of the first degree.
