A. Except as otherwise provided in the Code or building regulations of the City of McLoud, all fences in any area zoned as residential shall conform to the following standards:
1. Fences shall be constructed of suitable materials and maintained in good working condition, and may be chain link, wooden or synthetic stockade, wrought iron, wooden or synthetic picket, stone or brick masonry. Fences shall include a top rail when that is customary, such as with chain link. Fences may be of other material and design if approved in advance by Code Enforcement.
2. The following materials or designs are prohibited: T-post, barbed wire, razor wire, hog wire, chicken wire or similar materials. Fences designed or constructed to create the impression or appearance of a compound are prohibited.
3. Fences shall not be over eight feet (8') high on the rear or sides of any lot(s), and shall not be over five feet (5') high on any portion of the fence extending beyond the front of the residence.
B. This prohibition shall not apply to any fence in existence upon the effective date of this section, except in the event of a sale or transfer. Nothing herein shall be considered to restrict or limit the authority of the City to require the removal or repair of existing fences when authorized by other sections of the Code or building regulations, or when such fence is determined to be a nuisance or hazard to the public health and safety.
C. Any person who violates the provisions of subsection A of this section shall, upon conviction, be guilty of a misdemeanor punishable by a fine of two hundred dollars ($200.00). (Ord. 2017-07, 7-27-2017)
