A. Actions And Penalties For Nonpayment: Upon failure of any customer to pay any part of a utility bill for any utility services by the due date on the bill, the following actions and penalties may result: (Ord. 2003-07, 8-28-2003)
1. A late payment penalty, as established by the City Council by motion or resolution, shall be added to each utility bill not paid in full on or before the 15th day of the month or the first business day thereafter if the 15th is not a business day. The late payment penalty shall be added by four thirty o'clock (4:30) P.M. the date the payment is due.
2. Full payment of the utility bill must be made on or before the 25th day of the month, or the next business day if the 25th is not a business day. Upon failure to make the payment in full or make payment arrangements in writing, on or before the due date, the City, after mailing or posting notice of intent to disconnect or discontinue utility services, may disconnect or discontinue utility service. Customers may request, in writing, a hearing before the City Manager, regarding the termination or discontinuance of service. (Ord. 2018-06, 6-28-2018)
3. The authorized agents of the City may discontinue furnishing water to any customer refusing or neglecting to pay all or any part of a utility bill, upon providing written notice to the customer of the intent of the City to disconnect water service.
B. Reconnection Or Reestablishment Of Service: If any utility service is discontinued or disconnected pursuant to this section, the City, or its agents, shall not reconnect or reestablish the service until the full amount of any outstanding utility service bill is paid, plus any applicable charges or expenses incurred in reconnecting or reestablishing the service. Payments must be made with cash, cashier's check, or money order. No personal checks will be accepted after the twenty second of the month.
C. Added Charge For Disconnecting Service: If an occupant has been notified that utility service will be discontinued and City personnel have been dispatched to disconnect service, there shall be an additional fee added to the bill. All bills, penalties, and fees collected, as hereinabove specified, shall be paid to the Utility Clerk. Nothing herein shall be construed as preventing the City from instituting suit for the recovery of any delinquent accounts.
D. Payment Of Entire Utility Bill Required: The City Clerk may not accept payment of a water bill without payment of the sewer service charge; nor shall the Clerk accept payment of a sewer bill without payment of the water bill. The failure to pay any utility bill in accordance with subsections A and B of this section shall be grounds for discontinuing any or all of the utility services furnished to the customer whose bill is delinquent. E. Transfer Fee: Every person, firm or corporation desiring to have their utility service transferred to another location shall submit a request for transfer upon a printed form to be furnished for that purpose, and shall pay the transfer fee of twenty five dollars ($25.00) for that service.
