(A) Retail sales by the drink. Unless otherwise provided under this section, the lawful operating hours for licensed retail premises authorized to sell distilled spirits, wine, and malt beverages, by the drink shall be from the hour of 6:00 a.m. until the hour of 3:00 a.m. on Monday through Saturday.
(B) Retail package sales. Unless otherwise provided under this section, the lawful operating hours for licensed retail premises authorized to engage in the package sales of distilled spirits, wine, and malt beverages, shall be from the hour of 6:00 a.m. until the hour of 12:00 midnight on Monday through Saturday.
(C) Sunday sales. Unless otherwise provided under this section, a licensee shall not be permitted to conduct the retail sale of distilled spirits, wine, or malt beverages by the drink from the hour of 3:00 a.m. on Saturday until the hour of 6:00 a.m. on Monday, nor shall a licensee be permitted to conduct the retail package sale of distilled spirits, wine, or malt beverages from the hour of 12:00 midnight on Saturday until the hour of 6:00 a.m. on Monday.
(D) Retail sales by the drink at hotels, motels, and restaurants. The retail sales of distilled spirits, wine, and malt beverages by the drink shall be permitted on Sundays from 11:00 a.m. until 10:00 p.m. for hotels, motels and restaurants holding a nonquota type 2 license, as defined herein, provided such licensee meets each of the following express conditions precedent:
(1) The dining facility of the hotel, motel, and restaurant has a minimum seating capacity of 50 people at tables;
(2) At least 50% or more of the gross annual receipts from the dining facilities are received from the sale of food; and
(3) The licensee shall obtain a Sunday sales license.
(E) Election day sales. As provided in KRS 244.290, a licensee shall be permitted to sell distilled spirits, wine, or malt beverages by the package or by the drink during the hours that the polls are open on any primary, regular, local option, or special election day.
(F) Golf course sales. Pursuant to KRS 244.290(4) and 244.280(4) a holder of a limited golf course license shall be permitted to purchase, receive, possess, and sell distilled spirits, wine, or malt beverages at retail by the drink from the hour of 6:00 a,m. until the hour of 12:00 midnight, Monday through Sunday. Sunday sales of distilled spirits, wine, or malt beverages by the drink is expressly permitted.
(G) Small farm wineries. A licensed small farm winery shall be permitted to engage in the retail sale of alcoholic beverages on Sunday from the hour of 1:00 p.m. until the hour of 12:00 midnight.
(H) New Years Eve sales. A licensee shall be permitted to sell distilled spirits, wine, or malt beverages by the package or by the drink on New Years Eve until 3:00 a.m. on January lst. If New Years Eve falls upon a Sunday, distilled spirits, wine, and/or malt beverages may be sold by the package or by the drink commencing at 11:00 a.m. on December 31 until the hour of 3:00 a.m. on January 1.
