ADOPTING ORDINANCE
ORDINANCE NO. 2020-04
   AN ORDINANCE ADOPTING THE McCRACKEN COUNTY CODE OF ORDINANCES SUBMITTED BY AMERICAN LEGAL PUBLISHING CORPORATION OF CINCINNATI, ALONG WITH THE 2020 S-1 SUPPLEMENT
   WHEREAS, in 2018 the American Legal Publishing Corporation of Cincinnati, Ohio, at the request of the McCracken County Fiscal Court, completed the codification of McCracken County Ordinances to and including the end of 2018;
   WHEREAS, American Legal Publishing Corporation of Cincinnati, Ohio, has now completed the 2020 supplement to the Code of Ordinances of McCracken County (2020 S-1 Supplement), which supplement contains all Ordinances of a general nature enacted since the prior supplement to the Code of Ordinances of this municipality; and
   WHEREAS, American Legal Publishing Corporation has recommended the revision or addition of certain sections of the Code of Ordinances which are based on or make references to sections of the Kentucky Revised Statutes; and
   WHEREAS, it is the intent of Legislative Authority to accept these updated sections in accordance with the changes of the law of the Commonwealth of Kentucky; and
   WHEREAS, the McCracken County Fiscal Court realizes the importance of incorporation and adoption of said codification.
   NOW THEREFORE, BE IT ORDAINED BY THE FISCAL COURT OF MCCRACKEN COUNTY, COMMONWEALTH OF KENTUCKY, AS FOLLOWS:
Section 1.   Adoption of Original Codification.
   That the original codification of McCracken County Ordinances to and including the end of 2018, as submitted by American Legal Publishing Corporation of Cincinnati, Ohio, be and the same is hereby adopted by reference as if set out in its entirety.
Section 2.   Adoption of Supplement to Code of Ordinances.
   That the 2020 S-1 supplement to the Code of Ordinances of McCracken County, Kentucky, as submitted by American Legal Publishing Corporation of Cincinnati, Ohio, and as attached hereto, be and the same is hereby adopted by reference as if set out in its entirety.
Section 3.   Compliance with Open Meetings Laws.
   The McCracken County Fiscal Court hereby finds and determines that all formal actions relative to the adoption of this Ordinance were taken in an open meeting of said legislative body in full compliance with the Kentucky Open Meetings Act as modified by Section 8(b) of 2020 Senate Bill 150 and clarified in application by the published Advisory of the Kentucky Attorney General dated March 31, 2020. All deliberations of the Fiscal Court, if any, which resulted in formal action, were in meetings open to the public, in full compliance with the aforesaid legal requirements and all others germane to conduct of public meetings within the Commonwealth of Kentucky.
Section 4.   Conflicts.
   All ordinances, resolutions, orders or parts thereof in conflict with the provisions of this Ordinance are, to the extent of such conflict, hereby repealed and the provisions of this Ordinance shall prevail and be given effect.
Section 5.   Effective Date.
   This Ordinance shall be read on two separate days, published pursuant to KRS Chapter 242, and shall take effect and be in force from and after its date of passage, approval, and publication as recorded by law; the 11th day of May, 2020.
