§ 150.03  FENCE CONSTRUCTION PERMITS.
   (A)   No fence and/or wall shall be erected within the town without first applying for and obtaining a permit to erect the structure from the office of the Town Manager or his or her designee.
   (B)   The Town Manager or his or her designee shall proceed forthwith to prepare an application form and a permit form for individuals or entities wishing to construct fences and/or walls within the town to use in obtaining a fence and/or wall construction permit.
   (C)   The review process shall consist, in whole or in part, of a review of a site plan submitted by the applicant showing the exact location of the proposed fence and/or wall, as well as the location of all designated, dedicated, and/or apparent utility and/or drainage easements upon the subject real estate, all road rights-of-way, and. if requested, a description of the materials and height of the proposed fence and/or wall, in addition to any other information requested by the Town Manager or his or her designee deemed necessary in order to adequately review the application.  Should the proposed fence and/or wall encroach, or possibly encroach upon a designated, dedicated and/or apparent utility and/or drainage easement, the applicant shall, in addition to the provisions of this section comply in all respects with § 154.118(D)(3).
   (D)   The application shall be accompanied by the materials set forth in division (C) above, any other additional information required by the Town Manager or his or her designee and an application fee of $10, which shall be non-refundable.
   (E)   It shall constitute a violation of this section for anyone or entity to erect a fence and/or wall in violation of the provisions of this section and/or the Zoning Code and/or applicable restrictive zoning commitments, or failure to obtain the appropriate permit as contained within this section, with each day the violation exists to constitute a new and separate violation.
