§ 54.088 PERPETUAL CARE.
   (A)   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      PERPETUAL CARE. The care and maintenance of cemetery lots and columbarium in perpetuity. This care and maintenance shall include but not be limited to:
         (a)   Seeding of turf areas, and the regular cutting, trimming, and watering thereof;
         (b)   Pruning of shrubs and trimming of edgings and replacement of same;
         (c)   Tree surgery;
         (d)   Planting and maintenance of grave and lot covers;
         (e)   Removing litter and debris from lots;
         (f)   Care of ground covers other than turf;
         (g)   Maintenance of other appurtenances on lots as is not herein specifically mentioned;
         (h)   Care and maintenance of the columbarium and its accompanying appurtenances; and
         (i)   Capital improvements of the cemeteries.
   (B)   The City Council may by ordinance set the fee to be charged for perpetual care within all city cemeteries. The amounts shall be on file in the office of the City Clerk and are set out in Chapter 38, Fee Schedule.

   (C)   All sums paid, either directly or indirectly, for perpetual care, shall be set aside in a Perpetual Care Fund which shall be invested by the City Treasurer. The principal of this Fund may be used for capital improvements of the cemeteries upon the approval of the City Council. The interest thereof may be transferred to the General Fund to be expended in the care and upkeep of the cemeteries.
