(a) Whoever violates or fails to comply with any of the provisions of this chapter is guilty of a minor misdemeanor and shall be fined not more than one hundred dollars ($100.00) for each offense, if an individual, and not more than one thousand dollars ($1,000), if an organization, pursuant to the provisions of the General Offenses Code, for each offense. A separate offense shall be deemed committed each day during or on which a violation or noncompliance occurs or continues.
(b) Whoever is convicted of any subsequent violation of Section 917.16 shall, upon conviction, be deemed guilty of a misdemeanor of the fourth degree and shall be fined not more than two hundred fifty dollars ($250.00) or imprisoned not more than 30 days, or both, if an individual, and not more than two thousand dollars ($2,000), if an organization, pursuant to the provisions of Chapter 597 of the General Offenses Code, for each offense. Such persons shall be deemed guilty of a separate offense for each and every day or portions thereof during which any violation of any of the provisions of this chapter is committed, permitted or continued.
