(a) No person shall canvass, solicit or peddle within the City without first registering with the Public Safety Director or his or her authorized representative. A separate registration must be made for every solicitor, agent or employee canvassing, soliciting or peddling within the City. This section shall not apply to a national educational, civic, religious or charitable organization or purpose which, where applicable, is registered with the State as a bona fide charitable organization pursuant to Ohio R.C. Chapter 1716; a local charitable, educational, civic or religious organization; an individual campaigning for political office, either for himself or herself or on behalf of a political candidate; or an individual who is a resident of the City who is canvassing, soliciting or campaigning for the purpose of a local political issue, including, but not limited to, school levies and local referendums.
(b) Each applicant for a certificate of registration shall, not less than thirty nor more than forty-five days prior to the commencement of canvassing, solicitation or peddling, furnish the Director or his or her authorized representative with the following information on application forms provided by the City:
(1) The name, age and physical description of the applicant;
(2) The complete permanent and local addresses of the applicant, the name and address of the person for whom canvassing, soliciting or peddling is presently being done and the name and address of any other person for whom the applicant has solicited during the past three years;
(3) A general description of the nature of the business and the goods, services or wares to be sold, or a description otherwise sufficient to identify the subject matter of the canvassing, soliciting or peddling in which the applicant will engage;
(4) The names of five other municipalities in which the applicant has conducted canvassing, soliciting or peddling activities during the past twelve months;
(5) Whether the applicant has complied with the requirements of Ohio R.C. Chapter 1716 pertaining to charitable solicitations, if applicable;
(6) Whether the applicant has been denied a license or had a permit revoked, in the past ten years, including the time and place of such denial or revocation;
(7) Whether the applicant has ever been convicted of a felony violation or a misdemeanor violation involving moral turpitude, including the time and place of such conviction;
(8) The proposed dates and time of the canvassing, solicitation or peddling and the routes to be followed in conducting the same;
(9) The make, model, year, color and license plate number of automobiles used by the applicant during the period of canvassing, solicitation or peddling within the City, and the number of the applicant's driver's license and the state of issuance;
(10) Two photographs of the applicant, or two photographs of the applicant and each canvasser, solicitor or peddler on behalf of whom the applicant is applying for the certificate required by Section 763.02, of appropriate size (approximately two inches by two inches). One of each canvasser's solicitor's or peddler's photographs shall be attached at all times to the canvasser's, peddler's or solicitor's certificate and the other shall be for the records of the Police Department.
(11) Fingerprints are required to be taken of the applicant by the Police Department for local police files and for the purpose of determining the criminal record, if any, of the applicant. A fingerprint registration fee of seventy dollars ($70.00) is required to be paid by the applicant at the commencement of the application process, for the purpose of costs incurred for various law enforcement agency searches associated with the fingerprinting process; and
(12) A valid vendor's license if the applicant will be canvassing for a commercial purpose.
