(a) For the purpose of this Code, "motorized scooter" means a scooter that may or may not be titled and registered in accordance with Ohio motor vehicle laws and is powered by either:
(1) A combustion driven (gas) motor; or
(2) An electric driven motor ("electric scooter"), with a maximum speed of less than 15 miles per hour, which may or may not have a seat or saddle. A "motorized scooter" does not include a "motorized bicycle".
(b) No person shall operate a gas-powered, combustion driven motorized scooter of any kind on any public street, highway, alley, sidewalk, path or upon any other public property within the City.
(c) No person shall operate an electric powered motorized scooter on any public street or highway within the City. In order to traverse from sidewalk to sidewalk, crosswalks must be utilized at all times.
(e) No person under 14 years of age shall operate a motorized scooter unless they are wearing shoes and a protective helmet, free of damage and defects, on the person's head with the chin strap properly fastened.
(f) No operator of a motorized (electric) scooter shall do any of the following:
(1) Carry passengers, bundles or packages while the motorized scooter is in operation;
(2) Structurally alter the motorized scooter from the original manufacturer's design; or
(3) Operate said motorized scooter in a reckless, aggressive, negligent or wanton manner, or in such a fashion as to race with another vehicle.
A violation of any of the above conditions will result in the revocation of the motorized scooter license.
(g) Permitted hours of operation are from sunrise to sunset. If there is any dispute as to times of sunrise and sunset, the times shall correspond to times posted in a newspaper of general circulation in Northeast Ohio.
