1359.02 PERMIT APPLICATIONS AND ISSUANCE; PLANS AND SPECIFICATIONS.
   (a)   A part-owner, occupant or renter shall have permission from the owner of any lot, premises or parcel of land within the Municipality on which it is desired to install, construct or erect an earth station or a microdish; however the Municipality shall not require that the part-owner, occupant or renter obtain prior permission from the owner of any lot, premises or parcel of land for the installation of a satellite dish less than one meter in diameter. Application for installation shall be made to the Director of Buildings for the permit referred to in Section 1359.01.
   (b)   The Director of Buildings shall issue such permit, provided that the applicant submits a written application therefor upon forms provided by the Division of Building, Engineering and Inspection, along with:
      (1)   For the installation, construction or erection of an earth station, or for a microdish to be installed in a location other than the main structure, a copy of the manufacturer's construction and installation instructions and a plot plan of the lot, premises or parcel of land, which plot plan shall show the exact location of the proposed earth station or microdish and the location of all buildings on the subject lot and describe the kind of earth station or microdish proposed. With respect to the installation, construction or erection of an earth station to be installed in a location other than the roof of the main structure, the application shall also be accompanied by three complete sets of construction plans, specifications and elevations of the proposed location with sufficient details to show the method of assembly and construction. Each set of plans and specifications shall show the complete name and address of the subject property owner and the complete name and address of the person who prepared the plans and specifications.
      (2)   For the installation, construction or erection of a microdish, a copy of the manufacturer's construction and installation instructions and a plot plan which shall show the exact location on the roof of the main structure of the proposed microdish.

   (c)   The application shall indicate the owner of the subject property, the occupant of the subject premises, and the contractor or other person who will be permitted to install, construct or erect the proposed earth station or microdish.
   (d)   The installation or erection of earth stations or microdishes may be performed by the property owner or his or her agent. In the event that the installation of an earth station or a microdish involves the construction of a tower, the installer shall be a construction contractor pursuant to the ordinances of the City. All construction plans shall be certified with a professional engineer's stamp.
