139.05 DELINQUENT PAYMENTS PENALTY.
   (a)   A ten percent (10%) penalty shall be added to all utility accounts in which an outstanding balance remains on the current charges or any unpaid arrearages and remains outstanding by the end of business on the 15th of the month billed.
   (b)   An additional penalty in the amount of twenty percent (20%) may be added to all nonresidential utility accounts or bills for water or stormwater or sewage charges which are not received by the 15th of the month billed at the discretion of the Finance Director or City Administrator.
   (c)   Payment in full, for any utility account must be received by the 15th of the month in which it is billed to avoid a penalty and additional charges and fees.
   (d)   Utility service may be terminated for failure to pay the full amount due for any utility account. The account holder and/or property owner shall be assessed all fees related to the termination of utility service, and collection of a delinquent account, including court costs, collection fees and attorney fees.
   (e)   Penalties may be waived in full or in part by the Director of Finance for the purpose of compelling payment of past due amounts; encouraging electronic payments; electronic statement delivery or other as described in the rules and guidelines set forth in the policies adopted by and on file in the Finance office.
