(a) Notwithstanding any provision of this Code to the contrary, the Mayor, upon declaration of a state of emergency by proclamation as provided in Section 107.03, may authorize any department head to procure by purchase or lease, such goods, and services as are deemed necessary for the City's emergency response effort, up to a maximum dollar value of one hundred thousand dollars ($100,000) per emergency proclamation. This emergency procurement of goods or services may be made in the open market for immediate delivery or furnishing without complying with any state or local requirements for publication or competitive bidding, without filing a requisition or estimate, and without advertisement. A full written account of all emergency procurements made during this emergency, together with a requisition for the required materials, supplies, equipment, or services, shall be submitted to the Finance Department within ten (10) days after their procurement, and shall be public records and open to public inspection. Any department head may request from the Mayor an extension of time in which to submit such accounting. The Finance Director shall, within thirty days of the conclusion of the emergency, formally communicate these emergency expenditures in a full written account to the City Council.
(b) In the case of a real and present public emergency arising in connection with the operation of the Service Department, the Safety Department, or any other department of the City of Maumee, the City Administrator in consultation with the Mayor, Finance Director or Law Director may enter into contracts without formal bidding or advertising in amounts up to one hundred thousand dollars ($100,000) for work to be performed due to such emergency. City Council shall also have the authority to authorize contracts without formal bidding or advertising in amounts in excess of one hundred thousand dollars ($100,000.00) when there are emergencies arising in connection with the operation of any department in the City of Maumee.
