1335.09 CERTIFICATE OF APPROPRIATENESS ISSUED OR DENIED; DETERMINATION NOT MADE.
   In the event the Board determines that a certificate of appropriateness should be issued, within seven days of such determination, the secretary shall furnish a copy of the certificate of appropriateness to the applicant and if the application was not filed directly with the Board, to the official of the City originally receiving the application, and return the application to such City official for further proceedings.
   In the event the Board determines that a certificate of appropriateness should not be issued, within seven days of such determination, the secretary shall give written notice of such determination with the precise and specific reasons therefor and recommendations of the Board, if any, to the applicant and if the application was not filed directly with the Board, to the official of the City originally receiving the application and return the application to such City official.
   In the event the Board fails to make a determination that a certificate of appropriateness should be issued or should not be issued within forty-five days of the date of filing the application for a certificate or permit, excepting in cases where the application was filed directly with the Board pursuant to Section 1335.06, the application shall be returned promptly to the official of the City originally receiving the application for further proceedings, the necessity for a certificate of appropriateness shall be automatically dispensed with and the certificate or permit applied for shall not be withheld from issuance for lack of a certificate of appropriateness after the forty-fifth day following the date of the filing of the application. With respect to any application for a certificate of appropriateness filed directly with the Board, pursuant to Section 1335.06, the application shall be deemed to be denied if the Board fails to make a determination that a certificate of appropriateness should be issued or should not be given within forty-five days of the date of the application, and no reasons need be given, but this shall not preclude the Board from further considering such application after the forty-fifth day following the date of the filing of the application.
