§ 50.008 RIGHT OF ENTRY FOR PURPOSE OF INSPECTION; EASEMENT ON PRIVATE PROPERTY.
   (A)   The Superintendent with proper identification shall be permitted to enter onto all properties for the purposes of inspection, observation, measurement, sampling and testing pertinent to the discharge to the public system. The Superintendent may require additional samples or require a sampling control manhole in order to facilitate the sampling process.
   (B)   The Superintendent is authorized to obtain information concerning industrial processes which have a direct bearing on the kind and source of discharge. The Superintendent shall require plans and specifications for said private waste system prior to issuing a permit.
   (C)   The Superintendent, with proper identification, shall be permitted to enter all private properties through which the city holds an easement. Under the terms of pre-existing conditions, should the city discover sewer lines lying under private property without duly negotiated easements, the city may authorize the Superintendent to enter upon and conduct such activities as necessary to maintain the collection system. The city hereby assumes any contingent liability for damage to private property as may result from said actions as determined by the actual status of the physical condition of the surface land.
