§ 165.21 PICK-UP PLAN FOR DEPARTMENT HEADS AND CLERK.
   (a)   The statutorily required employees contributions for the city department heads and Clerk of Council to the State Public Employees Retirement System shall be withheld from the gross pay of the individuals, and shall be picked up by the city in lieu of contributions by these employees. This pick-up is and shall be designated as “employee contributions” and shall be the individual contributions to the Public Employees Retirement System for each employee. None of the aforementioned department heads or Clerk of Council shall have the option of choosing to receive the contributed amounts directly instead of having them picked up by the city.
   (b)   The city shall, in reporting and making remittance to the Public Employees Retirement System, attest that the pick-up of the employee contribution for the city department heads and Clerk of Council has been made by the city through direct contributions to the retirement system by each employee and that the contributions are designated as “employee contributions.”
